Terms & Conditions
These Terms and Conditions govern all custom 3D printing orders placed with Fynbos Forge. By submitting an enquiry or placing an order, you agree to be bound by these terms. Please read them carefully.
1. Definitions
- "Fynbos Forge" — the business providing the 3D printing service
- "Client" — the person or entity placing an order
- "Order" — a confirmed custom print commission accepted by Fynbos Forge
- "Print" — the physical item produced by Fynbos Forge for the Client
- "Brief" — the description, reference files, or specifications provided by the Client
2. Order Process
All orders begin with an enquiry submitted via our contact form, email, or Instagram DM. An order is only confirmed once:
- Fynbos Forge has reviewed and accepted the Brief
- Both parties have agreed on the design, colours, size, and timeline
- A 50% deposit has been received
Fynbos Forge reserves the right to decline any order at its sole discretion, including requests for prints that infringe intellectual property rights or involve illegal content.
3. Pricing and Payment
Prices are quoted on a per-order basis and are valid for 7 days from the date of quotation. Prices are quoted in South African Rand (ZAR) and include VAT where applicable.
- A 50% non-refundable deposit is required to begin production
- The remaining 50% balance is due before the print is dispatched or collected
- Payment methods: EFT, credit card, or debit card (as agreed at time of order)
Fynbos Forge will not begin printing until the deposit is cleared.
4. Turnaround Time
Estimated production timelines are provided at the time of quotation and are indicative only. While we make every effort to meet agreed deadlines, production times may vary due to print complexity, material availability, or circumstances beyond our control. We will communicate any delays promptly.
Rush orders may be accommodated at an additional charge, subject to capacity.
5. Client-Supplied Files and Designs
If you supply STL, OBJ, or other 3D model files:
- You confirm that you own or have the right to use and reproduce the design
- You indemnify Fynbos Forge against any third-party intellectual property claims arising from printing your supplied files
- Fynbos Forge is not responsible for print failures caused by defective or non-printable supplied files
- We may request modifications to files to ensure printability, and will confirm these with you before proceeding
6. Intellectual Property
Where Fynbos Forge designs or significantly modifies a model on your behalf, we retain rights to the design unless explicitly agreed otherwise in writing. You receive a licence to use the physical print produced. Fynbos Forge may use images of prints for portfolio and marketing purposes; if you prefer your order remain private, please notify us at time of order.
Fynbos Forge will not print items that infringe on registered trademarks, copyrighted characters, or other protected intellectual property without appropriate authorisation.
7. Quality and Approval
We strive for high-quality results on every print. Due to the nature of FDM (fused deposition modelling) 3D printing:
- Minor layer lines, slight colour variation between filament batches, and small surface artefacts are inherent to the process and do not constitute defects
- Colours on screen may differ slightly from printed colours
- For complex or high-value orders, we may send photos or video of the completed print for your approval before dispatch
8. Reprints and Remedies
If a print arrives damaged or contains a production error attributable to Fynbos Forge, we will reprint or issue a credit at our discretion. You must notify us within 5 business days of receiving the print and provide photographic evidence of the issue.
We are not liable for damage caused during shipping once the parcel is in the care of a courier. We recommend you inspect your parcel on delivery and report any courier damage to us promptly so we can assist with a claim.
9. Returns and Refunds
Because all prints are custom-made to your specification:
- The 50% deposit is non-refundable once production has commenced
- Completed prints cannot be returned or refunded unless they contain a demonstrable production defect (see clause 8)
- If you cancel an order before production begins, your deposit will be refunded less any design or preparation costs already incurred
These terms are consistent with the Consumer Protection Act 68 of 2008 in respect of special-order goods.
10. Shipping and Delivery
We ship nationwide across South Africa via courier. Shipping costs are quoted separately and are for the Client's account unless stated otherwise. Fynbos Forge is not responsible for delays caused by couriers, customs, or circumstances beyond our control. Risk in the print passes to the Client once the parcel is handed to the courier.
Local collection from Cape Town may be arranged by mutual agreement.
11. Limitation of Liability
To the fullest extent permitted by South African law, Fynbos Forge's liability in connection with any order is limited to the value of that order. We are not liable for any indirect, consequential, or special damages including loss of profit, loss of data, or reputational harm.
12. Governing Law
These Terms and Conditions are governed by the laws of the Republic of South Africa. Any disputes will be subject to the jurisdiction of the South African courts.
13. Changes to These Terms
We may update these Terms and Conditions from time to time. The effective date at the top of this page will reflect any changes. Orders already in progress are governed by the Terms in effect at the time of order confirmation.
